LAW - Defines Diasporas

Definition of Diasporas 

A Diaspora, from Greek word, scattering ‘dispersion’ is the movement, migration, or scattering of people away from an established or ancestral homeland or people dispersed by whatever cause to more than one location, or people settled far from their ancestral homelands.2

An article published in 1991, William Safran set out six rules to distinguish Diasporas from migrant communities. These included criteria that the group maintains a myth or collective memory of their homeland; they regard their ancestral homeland as their true home, to which they will eventually return; being committed to the restoration or maintenance of that homeland; and they relate "personally or vicariously" to the homeland to a point where it shapes their identity. While Safran's definitions were influenced by the idea of the Jewish Diaspora, he recognized the expanding use of the term.

Rogers Brubaker (2005) also notes that use of the term Diaspora has been widening. He suggests that one element of this expansion in use "involves the application of the term Diaspora to an ever-broadening set of cases: essentially to any and every nameable population category that is to some extent dispersed in space". 

The evident of the Diaspora in Malaysia is Chinese and Indian. Has come to Malaysia during British colonies time needed the workforces for tin miming and rubber planting as cheap labor. The emigration constitutes a diverse, heterogeneous and eclectic global community representing different regions, languages, cultures, and faiths.

Long after 500 years later some of the customaries are still being practice and some customaries has been banned restricted or changed within the law of Malaysia. There is some of customs been retained by the local consider danger or causing in other social issue.

Lunar Chinese New Year is the time where Chinese people go around visiting old friend, relative and family is a very important event, many people work far away from home will all come back home to have family gathering the Married person with children is a must to gives ‘Ang Pou’, a red little beg with paper money inside. It is a give of respect to old people and to bring good luck to children or person is not yet married. Family members will play firework and Mahjong is the Chinese culture. 

History of Fireworks, The discovery of fireworks, or namely the formulation of gunpowder is believed to have occurred by chance approximately 2,000 years ago at 7th century and originated in China. It is the most famous culture for Chinese in performing during Spring Festival (Chinese New Year) and the Mid-Autumn Festival were and still are times when fireworks are guaranteed sights. In Luna New Year festival in China every single household will be playing it as long as the night, you can easily purchase by the street and this has been banned in Malaysia under the Explosives Act 1957

Mahjong is a game that originated in China. In Asia, mahjong is also popularly played as a gambling game.It is an important activity in family gathering culture but under betting money has been restricted to leisure and und Common Gaming Houses Act 1953

There is another practice among the Indians such as Kootu. The tradition is the business practice that brought in into this Malaysia are to money lending or funding custom or activities that bring along from India, it is banned under Kootu Funds (Prohibition) Act 1971 (Act 28) , Amendment of section 3, under the proposed amendments, companies carrying out kootuschemes are liable to a fine of up to RM 500, 000 and/or 10 years' jail.
